This Refund and Return Policy explains how returns, refunds, replacements, and exchanges are handled for purchases made through elliotvaughn.com.
This policy forms part of our Terms of Service. It does not exclude, restrict, or modify any consumer guarantee, warranty, remedy, or other right that cannot lawfully be excluded, restricted, or modified.
1. OUR 30-DAY RETURN POLICY
We offer a voluntary 30-day return period for eligible products.
You must contact us within 30 days after the date on which the product was delivered to request a return.
Where products from the same order are delivered separately, the 30-day period for each product begins on the date that particular product is delivered.
This voluntary return policy applies to eligible:
- full-price products;
- sale products;
- discounted products;
- products purchased using a promotional code; and
- products purchased as part of a promotion.
A product is not excluded from our return policy merely because it was purchased at a reduced or promotional price.
The 30-day voluntary return period is separate from and does not replace any longer statutory rights relating to products that are faulty, unsafe, materially misdescribed, incorrect, or otherwise non-compliant.
2. CHANGE-OF-MIND RETURN REQUIREMENTS
To qualify for a voluntary change-of-mind return, the product must generally:
- be returned in substantially the same condition in which it was received;
- be unworn and unused, except for reasonable inspection or an indoor try-on;
- show no scratches, damage, bending, alteration, staining, makeup, hair-product residue, or other signs of extended use;
- include all original components, accessories, cases, cleaning cloths, certificates, tags, and complimentary items supplied with it;
- be returned with its original product packaging where reasonably possible; and
- be accompanied by valid proof of purchase.
Customers may reasonably inspect and try on sunglasses in the same way they would normally be permitted to inspect them in a physical retail store.
Wearing sunglasses outdoors, removing protective components, adjusting or altering the frame, fitting replacement lenses, or using the product beyond what is necessary to inspect its appearance and fit may make the product ineligible for a voluntary change-of-mind return.
Where a missing component or excessive handling has reduced the product’s value, we may reduce a voluntary refund to reflect the actual reduction in value, but only where permitted by applicable law.
3. SALE AND DISCOUNTED PRODUCTS
Sale, discounted, promotional, and coupon-purchased products are eligible for our voluntary 30-day return policy under the same eligibility requirements as full-price products.
This includes products purchased during:
- seasonal sales;
- introductory promotions;
- sitewide discounts;
- product-specific discounts;
- bundle promotions; and
- discount-code promotions.
The refund will be based on the amount actually paid for the returned product after all applicable discounts were allocated.
No refund will exceed the amount paid for the relevant product.
A discount or reduction in price does not affect any statutory rights relating to a faulty, unsafe, incorrect, misdescribed, or non-compliant product.
4. STARTING A RETURN
To request a return, contact:
Your request should include:
- your full name;
- your order number;
- the product or products you wish to return;
- the date the products were delivered; and
- the reason for the return, where relevant.
You do not need to provide a reason when exercising a statutory right that allows a return without justification.
For a damaged, defective, incorrect, or potentially unsafe product, please also provide a description of the problem and photographs or video where reasonably useful.
After reviewing the request, we will provide:
- return authorization;
- the applicable return address;
- packaging instructions;
- any required return reference number; and
- further instructions relevant to the return.
Do not send a product to our Hong Kong business office or to the address shown on the original shipping label.
Returns sent without authorization or to an unauthorized address may be delayed, redirected, or refused where permitted by law.
5. RETURN LOCATION
Approved returns are ordinarily processed through our designated return facility in Italy.
The exact return address will be provided after the return request has been reviewed and approved.
Our return facility may be located outside:
- the customer’s country;
- the country from which the order was dispatched;
- our Hong Kong business office; and
- the location of the fulfilment provider.
Customers must use the return address and instructions provided for their particular return.
We are not responsible for a return sent to a different address unless the incorrect address was provided by us.
6. DEADLINE FOR SENDING AN APPROVED RETURN
Unless a different period is required by applicable law, an approved voluntary return should be dispatched within 14 days after we provide the return instructions.
The customer should retain:
- the shipping receipt;
- the return tracking number;
- proof of the return address; and
- proof showing the date the return was dispatched.
A return request made within the 30-day period does not allow the customer to hold the product indefinitely before sending it back.
We may close a voluntary return authorization where the product is not dispatched within the stated period, unless the delay was reasonably unavoidable or applicable law requires a different outcome.
7. CHANGE-OF-MIND RETURN SHIPPING
Customers are generally responsible for the direct cost of returning a product because of:
- change of mind;
- fit preference;
- color preference;
- ordering the wrong product or variant;
- finding the product elsewhere at a different price; or
- another reason unrelated to a fault or error by Elliot Vaughn.
We do not currently provide prepaid return labels for ordinary change-of-mind returns unless we expressly agree otherwise.
For higher-value returns, we strongly recommend using:
- a tracked shipping service;
- delivery confirmation; and
- appropriate shipping insurance.
For voluntary change-of-mind returns, the customer remains responsible for the return shipment until it is delivered to the authorized return facility, subject to applicable law.
We cannot guarantee a refund for a voluntary return that cannot be verified as delivered.
8. ORIGINAL SHIPPING CHARGES
Original outbound shipping charges are generally non-refundable for a voluntary change-of-mind return.
Where an entire order qualified for free shipping, no outbound shipping amount will be deducted solely because the customer used our free-shipping offer, except where a separate promotional condition clearly stated otherwise before purchase and such a deduction is permitted by law.
Additional amounts paid for:
- expedited shipping;
- premium shipping;
- priority processing;
- shipping protection; or
- another optional delivery upgrade
are generally non-refundable for a change-of-mind return.
This section does not apply where applicable law requires us to refund standard delivery charges, including certain European Union statutory withdrawals, or where the return results from our error or a qualifying product problem.
9. DAMAGED, DEFECTIVE, UNSAFE, MISDESCRIBED, OR INCORRECT PRODUCTS
Please inspect your products as soon as reasonably possible after delivery.
Contact support@elliotvaughn.com promptly if a product:
- arrives damaged;
- is defective;
- may be unsafe;
- is materially different from its description;
- does not match the ordered product or variant;
- contains an incorrect prescription or lens specification;
- is missing an expressly included component; or
- otherwise fails to comply with an applicable consumer guarantee.
Please provide:
- your order number;
- a description of the issue;
- photographs or video where reasonably useful;
- photographs of the packaging and shipping label where relevant; and
- any other information reasonably necessary to investigate the issue.
A request for photographs or other supporting information does not remove or reduce your statutory rights.
We may reasonably inspect or assess a product before confirming the appropriate remedy.
Depending on the circumstances and applicable law, an available remedy may include:
- repair;
- adjustment;
- replacement;
- remake;
- reimbursement of reasonable return costs;
- partial refund;
- full refund; or
- another legally appropriate solution.
Where we confirm that the delivered product is defective, materially misdescribed, unsafe, or incorrect, we will cover reasonable return costs where required by law or provide another appropriate return method.
We will not require a customer to accept store credit where applicable law entitles the customer to a refund, replacement, repair, or another remedy.
10. NORMAL WEAR, ACCIDENTAL DAMAGE, AND MISUSE
Our voluntary return policy and statutory remedies do not ordinarily cover problems caused solely by:
- accidental damage after delivery;
- improper use;
- sitting or stepping on the product;
- dropping or crushing the product;
- exposure to excessive heat;
- improper cleaning;
- unauthorized repair or adjustment;
- fitting incompatible replacement lenses;
- failure to follow care instructions;
- ordinary wear and tear; or
- damage caused after risk has lawfully passed to the customer.
We may request reasonable information to distinguish a manufacturing or conformity issue from damage caused after delivery.
Nothing in this section permits us to deny a valid statutory remedy without a reasonable basis.
11. PRESCRIPTION AND CUSTOMIZED PRODUCTS
Prescription lenses, custom optical products, engraved products, and other products manufactured or modified according to a customer’s individual specifications may not be eligible for a voluntary change-of-mind return after manufacturing or customization has begun.
This may include:
- lenses manufactured according to an individual optical prescription;
- lenses cut or fitted for a particular frame;
- products manufactured using customer-specific optical measurements;
- products engraved with customer-selected content; and
- other clearly personalized products.
Where possible, contact us immediately if you need to cancel or correct a prescription order.
We may attempt to accommodate a cancellation or correction before manufacturing begins, but we cannot guarantee that a customized order can be cancelled once production has started.
The exclusion of customized products from voluntary change-of-mind returns does not apply where the product:
- was manufactured incorrectly;
- does not match the prescription or specifications provided and accepted;
- is defective or unsafe;
- is materially misdescribed;
- was damaged before delivery; or
- is otherwise covered by a mandatory consumer right.
Where a prescription submitted by the customer is incomplete, inaccurate, expired, or incorrect, the available remedy may depend on whether we manufactured the product according to the information supplied and whether applicable law provides otherwise.
12. NON-RETURNABLE ITEMS
The following are generally not eligible for a voluntary change-of-mind return:
- gift cards;
- products that have been materially used, worn, altered, or damaged after delivery;
- prescription or customized products described in Section 11 after production has begun;
- products not purchased from Elliot Vaughn;
- products that cannot be matched to a valid order;
- complimentary gifts returned separately from their qualifying purchase;
- products submitted as part of a fraudulent or abusive return; and
- any product separately and clearly identified as non-returnable before purchase, where such an exclusion is lawful.
Sale and discounted products are not included in this list and remain returnable when they meet the standard eligibility requirements.
No non-returnable classification limits a statutory remedy for a faulty, unsafe, incorrect, misdescribed, or otherwise non-compliant product.
13. COMPLIMENTARY GIFTS AND ORDER-THRESHOLD REWARDS
Certain orders may qualify for complimentary gifts or rewards based on the merchandise subtotal.
If a voluntary return reduces the retained order value below the threshold required for a complimentary gift, the gift must also be returned:
- unused;
- undamaged; and
- with its original packaging.
Where the customer chooses to keep the complimentary gift, we may deduct the gift’s clearly stated value from the voluntary refund, to the extent permitted by law.
Any deductible value will be based on the value disclosed:
- in the promotional terms;
- on the applicable product or promotion page;
- at checkout; or
- in the order confirmation.
No gift deduction will be made where:
- the value was not reasonably disclosed;
- the entire order is being returned because of our error;
- the qualifying product is faulty, unsafe, incorrect, or materially misdescribed and a deduction would interfere with a statutory remedy; or
- applicable law prohibits the deduction.
A complimentary gift cannot ordinarily be returned separately for cash or store credit.
14. BUNDLES, MULTI-BUY OFFERS, AND DISCOUNT ALLOCATION
Where an order was purchased through a bundle, multi-buy, percentage discount, buy-one-get-one offer, or similar promotion, any refund will be calculated using the amount actually paid and the discount allocated to the returned product.
The refund will not be calculated using the product’s undiscounted retail price where that price was not paid.
Where returning part of an order causes a complimentary gift or threshold reward to become unearned, Section 13 will apply.
Statutory remedies for faulty or non-compliant products remain unaffected.
15. EXCHANGES
We do not ordinarily process direct change-of-mind exchanges.
To obtain a different product, color, or variant:

request a return for the eligible original product;
-
return the product in accordance with this policy; and
-
place a new order separately.
A replacement provided as a remedy for a defective, damaged, unsafe, incorrect, or non-compliant product is not treated as a change-of-mind exchange.
We cannot reserve inventory or guarantee that a replacement product or variant will remain available while a return is in transit.
Any new order will be charged at the price displayed when the new order is placed.
16. REFUND ASSESSMENT
After an approved return is received, we may inspect it to confirm:
- that the correct product was returned;
- that it matches the relevant order;
- its condition;
- whether all required components were included;
- whether the product was altered or damaged after delivery;
- whether any complimentary gift must also be returned; and
- whether the return qualifies under this policy or applicable law.
We will notify the customer if:
- the return is approved;
- additional information is reasonably required;
- the refund amount is adjusted; or
- the voluntary return does not satisfy the stated eligibility requirements.
Where we reduce or deny a voluntary refund, we will provide a reasonable explanation.
A voluntary return may be denied where there is reasonable evidence of:
- return fraud;
- an empty or substituted return package;
- return of a different or counterfeit product;
- deliberate damage;
- falsified tracking or documents;
- repeated abuse of promotional offers; or
- another material misuse of the return process.
This does not permit us to deny a valid statutory right or remedy.
17. REFUND METHOD AND TIMING
Approved refunds are normally issued to the original payment method.
Unless a different deadline is required by applicable law, we aim to initiate the refund within 10 business days after:
- the approved return is received and inspected; or
- we confirm that a return is not required.
We do not charge a refund-processing fee.
After we initiate the refund, a bank, card issuer, PayPal, digital-wallet provider, or other payment provider may require additional time to display the transaction.
We do not control:
- bank processing periods;
- card-network delays;
- currency-conversion differences;
- foreign transaction fees; or
- exchange-rate changes between the purchase and refund dates.
The refunded amount will ordinarily be issued in the transaction currency and cannot exceed the amount actually paid, except where applicable law requires otherwise.
Where a payment was divided across multiple transactions or payment methods, the refund may also appear as multiple transactions.
18. STORE CREDIT
We may offer store credit as an optional resolution.
A customer is not required to accept store credit instead of a refund or other remedy where applicable law provides a right to:
- a refund to the original payment method;
- replacement;
- repair;
- cancellation; or
- another remedy.
Store credit issued as an agreed alternative may be subject to separate terms disclosed when the credit is offered.
19. REFUSED, UNCLAIMED, AND UNDELIVERABLE SHIPMENTS
If an order is returned because the customer:
- refused delivery without exercising an applicable cancellation right;
- failed to collect the shipment;
- supplied an incorrect or incomplete address;
- did not provide information required for delivery;
- did not pay applicable import duties or customs charges; or
- otherwise caused the shipment to be returned,
we may deduct reasonable and documented:
- outbound shipping costs;
- return-to-sender costs;
- customs charges;
- carrier charges; and
- handling or recovery costs
from any voluntary refund, to the extent permitted by law.
No deduction will apply where:
- the return resulted from our error;
- we failed to provide legally required information;
- the product was faulty, unsafe, incorrect, or materially misdescribed; or
- applicable law requires a different outcome.

20. LOST OR DAMAGED RETURN SHIPMENTS
For a voluntary change-of-mind return arranged and paid for by the customer, the customer should contact the selected return carrier regarding a shipment that is lost or damaged before reaching our return facility.
We recommend maintaining tracking and shipping-insurance records until the refund has been completed.
Where we provide a prepaid label or select the return carrier, responsibility for a lost return will be determined according to the circumstances and applicable law.
Nothing in this section limits a mandatory consumer right.
21. LATE OR MISSING REFUNDS
If you have not received an approved refund:
- check the original payment account;
- review whether the refund was divided into multiple transactions;
- contact your bank, card issuer, PayPal, or other payment provider; and
- allow the provider’s stated processing period to expire.
If more than 15 business days have passed since we confirmed that the refund was initiated, contact:

22. COUNTRY-SPECIFIC CONSUMER RIGHTS
United States
United States customers retain all non-waivable rights and remedies available under applicable federal and state law.
Our voluntary 30-day return program applies in addition to any mandatory rights.
State law may provide additional remedies where a product is defective, unsafe, misrepresented, or does not conform to an applicable warranty.
Canada
Canadian customers retain all non-waivable rights under applicable federal, provincial, and territorial law.
Nothing in this policy limits applicable rights relating to:
- legal warranties;
- defective or unsafe products;
- online-contract disclosures;
- non-delivery;
- misrepresentation;
- cancellation;
- refunds; or
- chargebacks.
Where Québec law applies, this policy is subject to the Québec Consumer Protection Act and other applicable Québec requirements.
Our voluntary change-of-mind policy will be honored according to its published conditions.
Australia
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Australian consumers may be entitled to a replacement or refund for a major failure and compensation for other reasonably foreseeable loss or damage.
Australian consumers may also be entitled to have goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
A major problem may include a product that:
- is unsafe;
- is substantially different from its description or sample;
- cannot be used for its normal purpose; or
- has a problem that would have prevented a reasonable consumer from purchasing it had they known about the problem.
Nothing in this policy excludes, restricts, or modifies an Australian consumer guarantee or remedy that cannot legally be excluded.
Sale and discounted products remain protected by the Australian Consumer Law.
Switzerland
Swiss customers retain all mandatory warranty, conformity, refund, cancellation, and contractual rights available under applicable Swiss law.
Nothing in this policy shortens a legally mandatory limitation period or excludes a remedy that cannot lawfully be excluded.
Our voluntary 30-day change-of-mind return program applies separately from any mandatory Swiss rights relating to defective or non-conforming goods.
European Union
This section applies where we sell or direct our services to a consumer residing in a European Union member state and European Union consumer law applies to the transaction.
Voluntary 30-day policy
Eligible European Union customers may use our voluntary 30-day return policy.
Where the return request is made after the statutory 14-day withdrawal period but within our voluntary 30-day period, the return will generally be treated as a voluntary change-of-mind return under the standard conditions of this policy.
Statutory 14-day right of withdrawal
Subject to applicable statutory exceptions, an European Union consumer purchasing online may withdraw from the purchase without providing a reason within 14 days after the day on which:
- the consumer receives the goods; or
- a third party designated by the consumer, other than the carrier, receives the goods.
For an order containing multiple products delivered separately, the withdrawal period begins after the final product is received.
To exercise the right of withdrawal, the consumer must send a clear statement of the decision to withdraw before the 14-day period expires.
The notice may be sent to:
The notice should include:
- the customer’s name;
- the order number;
- the products being returned; and
- the date on which the products were received.
After notifying us, the consumer must return the goods without undue delay and no later than 14 days after providing the withdrawal notice.
Unless we agree otherwise or applicable law requires us to bear the cost, the consumer is responsible for the direct cost of returning goods under the statutory withdrawal right. This responsibility is disclosed before purchase through this policy.
The consumer may inspect the goods only to the extent reasonably necessary to establish their nature, characteristics, and functioning.
The consumer may be responsible for any reduction in value resulting from handling beyond what would reasonably be permitted in a physical retail store.
EU withdrawal refunds
Where the statutory withdrawal right is validly exercised, we will reimburse:
- the amount paid for the returned products; and
- the cost of the least expensive standard outbound delivery option offered for the order.
We are not required to reimburse the additional cost of a premium, expedited, or other more expensive delivery method selected by the consumer, unless applicable law provides otherwise.
We will issue the reimbursement without undue delay and no later than 14 days after receiving the withdrawal notice.
We may withhold reimbursement until:
- we receive the returned goods; or
- the consumer provides satisfactory evidence that the goods were sent back,
whichever occurs first.
The reimbursement will be made using the original payment method unless otherwise expressly agreed.
EU withdrawal exceptions
The statutory withdrawal right may not apply to products:
- made to the consumer’s specifications;
- clearly personalized;
- containing prescription lenses manufactured according to individual optical information; or
- covered by another applicable statutory exception.
An exception to the withdrawal right does not remove remedies for products that are faulty, unsafe, incorrectly manufactured, materially misdescribed, or otherwise non-conforming.
EU faulty or non-conforming goods
European Union consumers retain the statutory legal guarantee applicable in their country of residence.
For new consumer goods, this generally includes a minimum two-year period beginning when the goods are delivered, although national laws may provide longer protection.
Where goods are faulty or fail to conform, the consumer may be entitled to remedies required by applicable law, including:
- repair;
- replacement;
- proportionate price reduction; or
- termination of the contract and a refund.
We will bear return and remedy-related costs where required by applicable law.
The expiration of our voluntary 30-day return period does not terminate or reduce these statutory rights.
Other jurisdictions
Customers in other jurisdictions retain any refund, return, warranty, cancellation, or consumer right that cannot legally be waived.
Where this policy conflicts with a mandatory legal right, the mandatory right will prevail to the extent of the conflict.
23. POLICY CHANGES
We may update this policy to reflect changes to:
- our products;
- our return processes;
- our fulfilment arrangements;
- our promotions;
- our prescription services;
- applicable law; or
- our business operations.
Updated terms will be posted on this page with a revised “Last updated” date.
Material changes will apply prospectively and will not retroactively reduce the return rights applicable to an order already placed, unless required by law or agreed with the customer.
24. RELATIONSHIP WITH OTHER POLICIES
This Refund and Return Policy should be read together with our:
- Terms of Service;
- Shipping Policy; and
- Privacy Policy.
Where an order-specific commitment expressly accepted by us provides greater return or refund rights than this general policy, the order-specific commitment will apply to that order.
Nothing in another policy will be interpreted to remove a mandatory right preserved by this policy or applicable law.
